Publisher

The App and Site are published by us, a software publisher based in the Netherlands, identified by the KvK and BTW-id shown in the Legal Notice. Contact: [email protected].

What is GateOpener

GateOpener is a companion app for GSM gate opener hardware modules (such as RTU5024 and Callny/Daniu). The App sends SMS messages and initiates phone calls to communicate with your gate hardware. The App does not include, manufacture, or sell any physical hardware.

Requirements

• A compatible GSM gate opener module (see Supported Devices in the App)
• An active SIM card in both your phone and your gate module
• Standard cellular service for SMS and phone calls

Purchase, payment, and VAT

GateOpener is sold through Google Play at a one-time price (currently EUR 4.99, plus any applicable taxes). Google Play, operated by Google Ireland Limited or its affiliates, processes the payment, applies VAT where required, issues receipts, and handles the customer relationship for the transaction. By purchasing the App you also agree to Google Play's terms of service.

Right of withdrawal (EU consumers)

Under EU consumer law, consumers normally have a 14-day right to withdraw from a digital purchase. Because the App is digital content delivered immediately upon purchase, this right is waived as soon as you start the download — Google Play asks you to confirm this waiver during purchase. After you start the download, the 14-day right no longer applies. Nothing in this clause limits any non-waivable right you have under your national consumer law.

Refunds

Refunds are handled by Google Play under Google's refund policy. You can typically request a refund within 48 hours of purchase from your Google Play order history. After that window, Google may grant refunds at its discretion. We are not able to issue refunds directly because we do not process or hold your payment data.

Carrier charges

The App sends SMS messages and makes phone calls through your phone's standard cellular service. Standard carrier rates apply. You are responsible for any charges from your mobile carrier for SMS messages and phone calls initiated by the App.

Hardware compatibility

The App supports devices using the RTU5024 and Callny/Daniu protocols. While we list 30+ compatible modules, we cannot guarantee compatibility with every hardware variant or firmware version. If your device is not supported, contact us and we will try to add support.

Security

• Device passwords are stored encrypted on your device using AES-256-GCM encryption
• You are responsible for keeping your device password secure
• We strongly recommend changing factory default passwords
• The security of your gate access depends on your phone's security (screen lock, biometrics) and your gate module's security settings

No warranty — provided "as is"

The App and the Site are provided "as is" and "as available", without warranty of any kind, express or implied — including (without limitation) implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, security, or uninterrupted operation. We do not warrant that:

• Your gate will open or close reliably — this depends on cellular coverage, hardware condition, SIM credit, weather, and other factors outside our control.
• SMS commands or phone calls will always be delivered, decoded, or acknowledged.
• The App is free of bugs, defects, or vulnerabilities.
• The App is compatible with every variant or firmware version of every supported module.
• The App will continue to be available, supported, or compatible with future operating system or hardware versions.

You use the App at your own risk. The App is not a substitute for proper gate hardware installation, maintenance, or independent security measures. Nothing in this clause excludes any warranty that cannot be excluded under applicable consumer law.

Your responsibilities

You are responsible for:

• Ensuring your gate hardware is properly installed and maintained
• Managing who has access to your gate (authorized users)
• The physical security implications of granting or revoking gate access
• Complying with local regulations regarding automated gate systems

Privacy

All data stays on your device. We do not collect, store, or transmit any personal data. Privacy Policy

Intellectual property

The App, the Site, and their content are owned by us. You may not copy, modify, distribute, sell, sublicense, reverse-engineer, or create derivative works of the App or Site, except as expressly allowed by applicable law.

Trademarks

GateOpener and the GateOpener logo are unregistered marks of the publisher identified in the Legal Notice. "Android" is a trademark of Google LLC. "RTU5024" and references to Callny, Daniu, BLIIoT, King Pigeon, and other module names are trademarks of their respective owners. References to those products are for compatibility identification only and do not imply any endorsement, affiliation, or sponsorship.

Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages arising from use of the App or Site — including but not limited to unauthorised gate access, lost or delayed SMS or calls, hardware malfunction, property damage, or business loss. Our total liability for any claim relating to the App or Site will not exceed the price you paid for the App. Nothing in these Terms limits or excludes our liability for (a) gross negligence or wilful misconduct, (b) personal injury or death caused by our negligence, (c) fraud, or (d) any other liability that cannot be limited or excluded under applicable law. If you are a consumer in the EU, EEA, or the UK, you keep the mandatory legal protections of the country where you live.

Acknowledgment and assumption of risk

You understand and accept that:

• GateOpener is a software interface to third-party gate opener hardware. It does not include, manufacture, or warrant any physical hardware.
• SMS and phone calls travel over public cellular networks. They can be delayed, intercepted, spoofed, or fail. SIM swapping, signal jamming, and similar attacks are possible against any GSM-based system.
• A gate opener controls physical access to a property. You — not us — are responsible for who can open your gate, whether your gate is properly installed, whether its security settings are appropriate, and the consequences of a gate opening or staying closed.
• The App is not a security or life-safety system. Do not use it as the sole means of access for emergencies, medical access, or any situation where a failure to open or close the gate could cause loss of life or serious injury.
• By using the App, you accept these risks and agree that we are not responsible for them.

Indemnification

You agree to defend, indemnify, and hold harmless us and our successors and assigns from any third-party claim, demand, or action — including reasonable legal fees — arising from or related to (a) your use or misuse of the App or Site, (b) your decisions about who to grant or revoke gate access to, (c) the security, configuration, or physical installation of the gate hardware you control, (d) any content you submit through forms on the Site, or (e) your breach of these Terms. We will tell you promptly about any claim and reasonably cooperate in your defence. Nothing in this clause requires a consumer to indemnify us beyond what is permitted by mandatory consumer law.

Force majeure

We are not responsible for any failure or delay caused by events outside our reasonable control — including cellular network outages, SMS or call delivery failures by carriers, Google Play or app-store outages, hosting provider downtime, hardware manufacturer issues, power failures, natural disasters, government actions, or internet infrastructure failures.

Termination

You may stop using the App at any time by deleting it. All locally stored data is permanently removed when the App is deleted. We may stop publishing or supporting the App, in whole or in part, with reasonable notice through the website or App store listing — clauses that by their nature should survive (intellectual property, limitation of liability, governing law) will continue to apply.

Changes to these terms

We may update these Terms. The updated version will be posted at this URL with a new "Last updated" date. Material changes will also be noted in the App's release notes when feasible. Continued use after the change date is acceptance of the new Terms.

Language

These Terms are drafted in English. Translations are provided for convenience. In case of any inconsistency, the English version governs, except where mandatory consumer law requires otherwise.

Severability

If any clause of these Terms is held invalid or unenforceable by a court of competent jurisdiction, that clause is to be limited to the minimum extent necessary; the rest of the Terms remains in full force.

Entire agreement

These Terms, together with the Privacy Policy and any policy expressly referenced here, are the complete agreement between you and us about the App and the Site, and replace any prior understanding on the same subject.

Assignment

You may not transfer your rights or obligations under these Terms. We may transfer ours, including in connection with a merger, acquisition, or sale of the GateOpener project, on the same conditions.

Governing law and venue

These Terms are governed by the laws of the Netherlands, excluding its conflict-of-laws rules. Disputes will be brought before the courts of Amsterdam, except that EU consumers may also bring proceedings in the courts of the country where they live, as required by EU law. EU consumers may also use the European Commission Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
